All deposits are held in our trust account and will be refunded in accordance with the Act.

Under the Motor Car Traders Act 1986 (Vic), if you purchase a used motor vehicle from us as a consumer, you are entitled to a 3 clear business day cooling-off period commencing on the day you receive a copy of the signed contract of sale. During this period, you may rescind the contract by giving written notice to us. If you exercise this right: • A refund of your deposit will be provided, less a cooling-off fee of $100 or 1% of the purchase price (whichever is greater, up to a maximum of $100 for vehicles priced under $10,000, and up to $500 for vehicles $10,000 and above), as prescribed by the Act. • The cooling-off right does not apply if the vehicle is purchased at a publicly advertised auction, or if you have had the vehicle independently inspected before purchase, or if the purchase is wholly for business purposes. Under the Motor Car Traders Act 1986 (Vic) and the Australian Consumer Law (ACL), used vehicles sold by a licensed motor car trader to a consumer carry statutory warranty entitlements. Victorian Statutory Warranty applies to vehicles: • With an odometer reading of less than 160,000 km at time of sale, AND • The vehicle is less than 10 years old from the date of manufacture. Warranty Period: • Vehicles with odometer reading under 130,000 km: 3 months or 5,000 km (whichever occurs first). • Vehicles with odometer reading 130,000 km to 160,000 km: 1 month or 1,000 km (whichever occurs first). The statutory warranty covers major mechanical and electrical components. It does not cover consumables (tyres, brake pads, light globes), bodywork, trim, or issues caused by misuse, neglect, accident, or modifications after sale. Vehicles sold as "Unregistered" or as "repairable write-offs" are excluded from statutory warranty. Japanese import vehicles that do not meet statutory warranty eligibility criteria will be clearly disclosed prior to sale. In addition to statutory warranty, your rights under the Australian Consumer Law (including consumer guarantees of acceptable quality, fitness for purpose, and correspondence with description) apply to all our vehicles regardless of price or age.

Under the Road Safety Act 1986 (Vic), a Roadworthy Certificate (RWC) is required when transferring registration of a used vehicle in Victoria. Japtralia Vehicle Import will provide a current RWC issued by a VicRoads-approved vehicle tester for all registered used vehicles sold unless otherwise clearly stated and agreed in writing. Where a vehicle is sold unregistered or in an "as-is" condition (e.g., an older import or vehicle sold for parts/project), this will be explicitly disclosed on the contract of sale and invoice.

We take all reasonable steps to ensure vehicle descriptions, specifications, odometer readings, and advertised prices are accurate at the time of listing. Odometer readings for Japanese import vehicles are sourced from official Japanese auction records and are displayed in kilometres. All vehicles are described to the best of our knowledge and in accordance with our obligations under the Australian Consumer Law and the Motor Car Traders Act 1986 (Vic). We disclose known defects and encumbrances to the extent required by law. We recommend all purchasers conduct their own independent inspection and/or PPSR (Personal Property Securities Register) check prior to purchase. A PPSR check confirms whether a vehicle has money owing, has been reported stolen, or is a write-off. You can conduct a PPSR check at: ppsr.gov.au

Japtralia Vehicle Import ensures all vehicles sold are free of financial encumbrance (money owing) at the time of sale and transfer. However, we strongly encourage all purchasers to independently verify the vehicle's status by conducting a PPSR check at ppsr.gov.au. A PPSR certificate provides confirmation of: • Whether finance is registered against the vehicle (security interest). • Whether the vehicle has been reported stolen. • Whether the vehicle is a written-off vehicle. • Whether the vehicle is subject to any other registered interest. The cost of a PPSR search is approximately $2 AUD (Government fee). This is the buyer's responsibility unless otherwise agreed.

Japtralia Vehicle Import may accept deposits to secure a vehicle. All deposits are held in our trust account as required under Section 26 of the Motor Car Traders Act 1986 (Vic). ONLINE RESERVATIONS VIA THIS WEBSITE Where a customer pays a deposit online via this website: • Payment is processed securely by Stripe Pty Ltd (PCI-DSS Level 1 compliant). Japtralia Vehicle Import does not store your card details — they are tokenised and handled directly by Stripe. • The default deposit amount shown at checkout is $200 AUD unless otherwise stated. • The deposit secures the vehicle for up to 72 hours from the time of payment, during which our sales team will contact you by phone, email, SMS or WhatsApp to finalise a contract of sale. • Payment of the deposit does not constitute a binding contract of sale. A binding contract for the purchase of the vehicle arises only upon execution of the written contract of sale. REFUNDABLE DEPOSIT Deposits paid online are refundable (less the prescribed cooling-off fee where applicable) where: • Japtralia Vehicle Import is unable to supply the vehicle as described. • The vehicle fails to obtain a Roadworthy Certificate and the parties cannot agree on rectification. • The customer exercises the cooling-off right under the Motor Car Traders Act 1986 (Vic) within the 3 clear business day cooling-off period. • A finance application is rejected and the deposit was paid on the express written condition that the sale was subject to finance approval. NON-REFUNDABLE DEPOSIT Deposits become non-refundable where: • The cooling-off period has expired AND the customer has signed or confirmed the contract of sale in writing. • The customer cancels the reservation after the vehicle has been removed from sale in reliance on the deposit. • The customer provides materially false information or fails to respond to reasonable contact from our sales team for 7 calendar days. COOLING-OFF FEE The prescribed cooling-off fee under the Motor Car Traders Act 1986 (Vic) is the greater of $100 or 1% of the purchase price, up to a maximum of $100 for vehicles priced under $10,000 and $500 for vehicles $10,000 and above. SALES FOLLOW-UP Upon successful payment of an online deposit, a member of our sales team will contact you within one business day via phone, email, SMS or WhatsApp to finalise the contract of sale, arrange delivery or pickup, and discuss finance, trade-in and warranty options. The contract of sale must be signed prior to delivery or transfer of ownership. LIMITATION OF LIABILITY To the maximum extent permitted by law, Japtralia Vehicle Import's liability for any dispute relating to the deposit is limited to refund of the deposit amount. Nothing in these terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law or any other non-excludable law. OFFLINE PAYMENTS Full payment is required prior to delivery or transfer of ownership unless a finance arrangement has been confirmed in writing. Accepted payment methods: bank transfer (EFT), bank cheque, or approved finance. Personal cheques are not accepted. GOVERNING LAW These terms are governed by the laws of Victoria, Australia, and any dispute is subject to the exclusive jurisdiction of the courts of Victoria.

Japtralia Vehicle Import may refer customers to third-party finance providers. We are not a credit provider. Any finance product offered is subject to the lender's terms, conditions, and credit approval. Finance referrals are provided as a convenience only. We encourage you to read all finance documents carefully and seek independent financial advice if required. Finance comparisons should be made using the comparison rate, which incorporates fees and charges. Our finance referral arrangements are disclosed to customers as required under the National Consumer Credit Protection Act 2009 (Cth).

Where a trade-in vehicle is offered as part of a purchase, the trade-in value agreed will be clearly documented on the contract of sale. Trade-in valuations are provided based on the information given by the seller at the time of inspection. The agreed trade-in value may be adjusted if information provided is found to be materially inaccurate (e.g., undisclosed accident damage, odometer discrepancy, or outstanding finance). Sellers of trade-in vehicles must ensure they have clear title to the vehicle being traded and that there are no outstanding financial encumbrances, pending infringement notices, or other claims against the vehicle.

Japtralia Vehicle Import offers delivery to most locations across Australia. Delivery is arranged via third-party transport carriers. Delivery costs, timeframes, and responsibility for insurance in transit will be agreed in writing prior to dispatch. Risk in the vehicle passes to the buyer upon collection or delivery, as documented in the contract of sale. We recommend buyers arrange comprehensive insurance to commence from this point.

Many vehicles in our stock are sourced directly from Japan via licensed importers and comply with Australian Design Rules (ADR) or have been complianced to meet relevant standards. The following applies specifically to Japanese import vehicles: • All odometer readings are converted and stated in kilometres. • Import vehicles undergo a roadworthy inspection and compliance check prior to registration. • Japanese auction grade reports and inspection records are available on request. • Some import vehicles may have right-hand-drive configurations with minor cosmetic or specification differences from Australian-delivered models. • Any known structural, flood, or accident history disclosed in Japanese auction documentation will be communicated to the buyer. Compliance plates and VIN numbers are verified prior to sale.

Japtralia Vehicle Import collects personal information for the purposes of facilitating the sale of vehicles, arranging finance referrals, processing enquiries, and complying with our legal obligations under the Motor Car Traders Act 1986 (Vic) and related legislation. We handle your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). We do not sell or share your personal information with third parties except as required to facilitate the transaction (e.g., finance providers, registration authorities, transport carriers). We are bound by the decisions of Consumer Affairs Victoria in relation to our LMCT obligations.

These terms and conditions are governed by the laws of the State of Victoria and the Commonwealth of Australia, including but not limited to: • Motor Car Traders Act 1986 (Vic) • Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)) • Road Safety Act 1986 (Vic) • Privacy Act 1988 (Cth) • National Consumer Credit Protection Act 2009 (Cth) • Personal Property Securities Act 2009 (Cth) Any disputes are subject to the exclusive jurisdiction of the courts of Victoria.
